The UK Spouse Visa, also known as a partner visa, allows foreign nationals to live in the UK with a British or settled partner, enabling them to live and work in the UK. This visa is for legally married couples or those in a civil partnership, and unmarried couples who have cohabited for at least two years. After five years on a Spouse Visa, individuals can apply for Indefinite Leave to Remain (ILR) and eventually, British citizenship.

Key aspects of the UK Spouse Visa:

  • Eligibility:
    To be eligible, both partners must be over 18, and the British/settled partner must be a British citizen, have indefinite leave to remain, settled status, pre-settled status (for EU, Switzerland, Norway, Iceland, and Liechtenstein), have a Turkish Businessperson or Turkish Worker visa, have protection status (refugee, humanitarian protection), or have permission to stay as a stateless person. 
  • Relationship:
    The visa requires evidence of a genuine and subsisting relationship, including proof of marriage or cohabitation. 
  • Financial requirements:
    The applicant and their sponsoring partner must demonstrate they meet the minimum income threshold, which is usually £29,000 per year.
  • English language:
    Applicants must meet the required English language proficiency, demonstrated through a recognized English language certificate or by having previously resided in an English-speaking country. 
  • Accommodation:
    Suitable accommodation in the UK is required.
  • Visa duration and extension:
    The Spouse Visa is initially granted for a period of 2 years and 9 months (33 months for those applying from outside the UK) and can be extended for another 30 months, allowing a total stay of 5 years. 
  • Indefinite Leave to Remain:
    After five years on a Spouse Visa, individuals can apply for Indefinite Leave to Remain, which allows them to settle permanently in the UK.
  • British citizenship:
    After meeting the requirements for Indefinite Leave to Remain and meeting further criteria, individuals can apply for British citizenship.

  4. Pay Fee: Pay the application fee. 
  5. Biometric Information: Attend your biometric appointment. 
  6. Submit Application: Submit your application and supporting documents. 
  7. Wait for Decision: The UK Visas and Immigration will review your application. 
  8. If Successful: You will receive your visa and can travel to the UK
