The "SET (DV)" visa application, also known as the Indefinite Leave to Remain (ILR) as a victim of domestic violence, allows individuals on spouse or partner visas to apply for permanent residency in the UK if their relationship has broken down due to domestic abuse. This application is made online using the SET (DV) form, and it's crucial to understand the eligibility requirements outlined in Appendix Victims of Domestic Abuse of the Immigration Rules.

Eligibility:

  • Victim of Domestic Abuse:
    You must be the victim of domestic violence or abuse from your partner or their family.
  • Spouse or Partner Visa:
    You must be on a spouse or partner visa or have previously been granted permission to stay in the UK as a partner.
  • Relationship Breakdown:
    Your relationship with your partner must have irretrievably broken down due to domestic violence or abuse.
  • Evidence:
    You may be required to provide evidence of the abuse, such as police reports or medical records, but it is not always mandatory.

Application Process:

  1. Online Application:
    The application is submitted online using the SET (DV) form,

      You will need to provide information and evidence to support your claim of domestic violence.
  2. Submit the Application:
    Once you have completed the application, you will need to submit it online.
  3. Decision:
    The Home Office will assess your application and make a decision based on the evidence and information provided.
