Care Orders

A care order is a court order that allows a local authority (like a council) to take a child into care. It essentially gives the local authority parental responsibility for the child, sharing it with the child's parents. This means the local authority can make decisions about where the child lives, their school, and other important aspects of their life.

  • Purpose:
A care order is granted when a court believes a child is suffering or at risk of significant harm, and their parents cannot provide adequate care.
  • Parental Responsibility:
When a care order is made, the local authority shares parental responsibility with the child's parents.
  • Local Authority's Role:
The local authority is responsible for the child's welfare, including providing accommodation, support, and care. They can also make decisions about the child's education, healthcare, and contact with family.
  • Interim vs. Final:
A court can issue an interim care order temporarily, while they determine the child's long-term needs. A final care order is a permanent order, meaning the local authority will continue to have shared parental responsibility until the child turns 18 or the order is discharged.
  • Duration:
A care order typically lasts until a child turns 18, but it can end earlier if the child is adopted, a residence order is made, or the court discharges the order.
  • Applications:
Local authorities can apply for a care order if they believe the threshold criteria (that a child is suffering or at risk of significant harm) have been met.
