7 Year Private Life For Children

The UK's "7-year private life route" allows children, including those born in the UK, to apply for Indefinite Leave to Remain (ILR) if they have lived continuously in the UK for at least 7 years. This route is part of the broader private life rules, which consider the time a person has spent in the UK and the private life they have built here.

Key aspects of the 7-year route:

  • Continuous Residence: The child must have lived continuously in the UK for at least 7 years.
  • Age: The child's age is not a factor in this route, as long as they have met the continuous residence requirement.
  • Applying on their own or as part of a family: The child can apply on their own or as part of a family application.
  • No need for a sponsor: The child does not need a sponsor or a specific type of visa to be eligible for this route.

How the 7-year rule works in practice:

  1. Eligibility:
If a child was born in the UK and has lived continuously here for 7 years, they can apply for ILR
  2. Application:
The application is made under the private life rules, and the Home Office will assess whether it would be reasonable to expect the child to leave the UK.
  3. ILR:
If the application is successful, the child will be granted ILR, allowing them to settle in the UK permanently.
  4. Family Members:
The child's parents or other family members may also be able to apply for leave to remain if they can show they are responsible for the child and it would not be reasonable for them to leave the UK.

Important Considerations:

  • "Reasonable" to leave:
The Home Office will consider whether it would be reasonable to expect the child to leave the UK, taking into account factors such as their age, the strength of their ties in the UK, and any other relevant circumstances.
  • Other Private Life Routes:
There are other routes to ILR under the private life rules, such as for individuals who have lived in the UK for a long period (e.g., 20 years) or for young people who came to the UK as children.
  • Financial and English Language requirements:
In some cases, individuals applying under private life may also need to demonstrate that they are financially independent and have an adequate command of English.
