Forced Marriage Protection Order

Forced Marriage Protection Order (FMPO) is a legal tool designed to protect individuals from being forced into marriage or to aid those already in a forced marriage. It's a civil injunction issued by the family court that aims to prevent the forced marriage from taking place, protect the victim from harm, and impose restrictions on the person or persons attempting to force the marriage.

Key aspects of a Forced Marriage Protection Order:

  • Purpose: To prevent a forced marriage or protect someone already in one.
  • Legal Basis: The Forced Marriage (Civil Protection) Act 2007 provides the framework for FMPOs.
  • How it works: The order can prohibit certain actions by the person trying to force the marriage, such as contacting the victim, taking them out of the country, or making marriage arrangements. It can also require them to take specific actions, like handing over passports or ensuring the victim attends school.
  • Unique to Each Case: FMPOs are tailored to the specific circumstances of each case.
  • Enforcement: Disobeying a FMPO is a criminal offense with a maximum penalty of 5 years imprisonment.
  • Who can apply: The individual at risk, or on their behalf, can apply for an FMPO. This can include relatives, friends, voluntary workers, or the police.
  • Emergency Orders: FMPOs can be made urgently, without notice to the respondent, to provide immediate protection.
  • Legal Aid: Legal Aid may be available for individuals eligible to seek assistance from a solicitor in obtaining the order or dealing with a breach of the order.
